Introduction
These Terms and Conditions govern your use of the Stop Light Alert System ("the System"), an app-based product provided by No Student Unseen ("we," "us," "our"). The System is designed as a mental health screening tool to support students’ mental and emotional wellness within the school system.

Acceptance of Terms
The System is intended for use by educational institutions, including but not limited to schools, colleges, and universities, as well as students and the general public for the purpose of submitting reports via the Black Light Alert feature. Use of the System is limited to authorized users, including school administrators, teachers, authorized staff, students, and members of the public.

Users agree to use the System in accordance with its intended purpose and to submit genuine and accurate reports. Any misuse of the System may result in suspension or termination of access.

User Responsibilities
Users of the System agree to:- Use the System in a manner consistent with its intended purpose and functionality.
- Protect the confidentiality of any personal and sensitive information encountered within the System.
- Comply with all applicable laws and regulations regarding student privacy, data protection, and reporting responsibilities.
- Not use the System for any unlawful or prohibited activities.

Intellectual Property Rights
The System and its original content, features, and functionality are and will remain the exclusive property of No Student Unseen and its licensors.

The use of the System is also governed by our Privacy Policy, which outlines our practices concerning the collection, use, and disclosure of user data.

Compliance with HIPAA:
We are committed to ensuring that our server-side operations comply with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") where applicable, particularly in regards to any protected health information ("PHI") that may be processed or stored.

Server-Side Protections:
Our security measures are in line with the HIPAA Security Rule and include, among others, encryption, access controls, and audit controls to protect the integrity, confidentiality, and availability of PHI.

User Obligations:
Users covered by HIPAA must ensure their use of the System complies with HIPAA and must implement safeguards for PHI. Users are responsible for reporting any PHI breaches in accordance with HIPAA guidelines.

Business Associate Agreement:
If a BAA is required under HIPAA, it must be executed to govern the handling of PHI.

Limitation of Liability
We shall not be liable for indirect or consequential losses arising from the use of the System, and our liability is limited to the fullest extent permitted by law.

Indemnification
You agree to indemnify No Student Unseen against all liabilities, costs, and expenses arising from your use of the System or your breach of these Terms.

Termination
We may terminate or suspend your access to the System immediately, without prior notice, for any breach of these Terms.

Changes
We reserve the right to modify these Terms at any time. Continued use of the System after changes indicates acceptance of the new Terms.
